End User License Agreement
CAREFULLY READ THE FOLLOWING LICENSE AGREEMENT. YOU ACCEPT AND AGREE TO BE BOUND BY THIS LICENSE AGREEMENT BY 
CHECKING THE BOX LABELED "I ACCEPT" OR PLACING THE ORDER. IF YOU DO NOT AGREE TO THIS LICENSE, DO NOT CHECK THE ACCEPT BUTTON OR PLACE THE ORDER AND YOU WILL NOT BE CHARGED AND THE SOFTWARE WILL NOT BE SHIPPED TO YOU.

License Grant
The package contains software ("Software") and related explanatory written materials ("Documentation"). "Software" includes any data, Global Positioning System (GPS) interface, upgrades, modified versions, updates, additions and copies of the Software. "You" means the person or company who is being licensed to use the Software or Documentation. "We" and "us" and "our" mean A1-Hobby.
We hereby grant you a nonexclusive license to use one copy of the Software on any single computer, provided the Software is in use on only one computer at any time. The Software is "in use" on a computer when it is loaded into temporary memory (RAM) or installed into the permanent memory of a computer - for example, a hard disk, CD-ROM or other storage device. 
If the Software is permanently installed on the hard disk or other storage device of a computer (other than a network server) and one person uses that computer more than 80% of the time, then that person may also use the Software on a portable or home computer.
Title
We remain the owner of all rights, title and interest in the Software and Documentation. 
Archival or Backup Copies
You may either:
·	make one copy of the Software solely for backup or archival purposes, or
·	transfer the Software to a single hard disk, provided you keep the original solely for backup or archival purposes.
Things You May Not Do
The Software and Documentation are protected by United States copyright laws and international treaties. You must treat the Software and Documentation like any other copyrighted material--for example a book. You may not:
a.	copy the Documentation,
b.	copy the Software except to make archival or backup copies as provided above,
c.	modify or adapt the Software or merge it into another program,
d.	reverse engineer, disassemble, decompile or view the Software in any human-readable form  or make any attempt to discover the source code of the Software,
e.	place the Software onto a server so that it is accessible via a public network such as the Internet, 
f.	sublicense, rent, lease or lend any portion of the Software or Documentation, or give any public demonstration, 
g.	modify or apply any modifications to the Software, even if they are licensed modifications, if this Software is labeled as a demo version,
h.	use the software or permit the software to be used for any purpose other than entertainment. In particular, you agree not to use the software or permit the software to be used for navigation or any purpose involving life or property.
Transfers
You may transfer all your rights to use the Software and Documentation to another person or legal entity provided you transfer this Agreement, the Software and Documentation, including all copies, updates and prior versions to such person or entity and that you retain no copies, including copies stored on computer. You may not transfer any user customised data such as waypoints or icons with the software. You may not transfer the software to a minor.
Limited Functionality "Demonstration" version:
If this product is a limited functionality demonstration version, you may only transfer the complete and unmodified installation package along with this license agreement.
Limited Warranty
We warrant that for a period of 60 days after delivery of this copy of the Software to you:
·	the physical media on which this copy of the Software is distributed will be free from defects in materials and workmanship under normal use, and
·	the Software will perform in substantial accordance with the Documentation.
·	If this product is a limited functionality demonstration version, it is being provided "As Is" with no warranties expressed or implied.
To the extent permitted by applicable law, THE APPLICABLE FOREGOING LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, AND WE DISCLAIM ANY AND ALL IMPLIED WARRANTIES OR CONDITIONS, INCLUDING ANY IMPLIED WARRANTY OF TITLE, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, regardless of whether we know or had reason to know of your particular needs. No employee, agent, dealer or distributor of ours is authorized to modify this limited warranty, nor to make any additional warranties.
SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
Limited Remedy
Our entire liability and your exclusive remedy shall be:
1.	the replacement of any diskette(s) or other media not meeting our Limited Warranty which is returned to us or to an authorized Dealer or Distributor with a copy of your receipt, or
2.	if we or an authorized Dealer or Distributor are unable to deliver a replacement diskette(s) or other media that is free of defects in materials or workmanship, you may terminate this Agreement by returning the Software and Documentation and your money will be refunded.
IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OR THE INABILITY TO USE THE SOFTWARE (EVEN IF WE OR AN AUTHORIZED DEALER OR DISTRIBUTOR HAS BEEN ADVISED OF THE POSSIBILITY OF THESE DAMAGES), OR FOR ANY CLAIM BY ANY OTHER PARTY.
SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Term and Termination
This license agreement takes effect upon your use of the Software and remains effective until terminated. You may terminate it at any time by destroying all copies of the Software and Documentation in your possession. It will also automatically terminate if you fail to comply with any term or condition of this license agreement. You agree on termination of this license to either return to us or destroy all copies of the Software and Documentation in your possession.
Confidentiality
The Software contains trade secrets and proprietary know-how that belong to us and it is being made available to you in strict confidence. ANY USE OR DISCLOSURE OF THE SOFTWARE, OR OF ITS ALGORITHMS, PROTOCOLS OR INTERFACES, OTHER THAN IN STRICT ACCORDANCE WITH THIS LICENSE AGREEMENT, MAY BE ACTIONABLE AS A VIOLATION OF OUR TRADE SECRET RIGHTS.
General Provisions
1.	This written license agreement is the exclusive agreement between you and us concerning the Software and Documentation and supersedes any and all prior oral or written agreements, negotiations or other dealings between us concerning the Software or Documentation.
2. This license agreement may be modified only by a writing signed by you and us.
3.	In the event of litigation between you and us concerning the Software or Documentation, the prevailing party in the litigation will be entitled to recover attorney fees and expenses from the other party.
4.	You agree that this Agreement will be governed by the laws of the State of California and further agree to bring any and all causes of action arising from this agreement only in the County of Ventura, State of California. 
5.	You agree that the Software will not be shipped, transferred or exported into any country or used in any manner prohibited by the United States Export Administration Act or any other export laws, restrictions or regulations.
6.	You agree that this software may not be purchased, installed, or used by minors. Furthermore, you agree to take reasonable steps to prevent access to or use of the software by minors.
7.	You agree not to install or use the software on systems that do not meet the hardware requirements in the documentation.
8.	You agree not to purchase, install, analyze or use the software as part of any employment function or as a government employee or contractor in any official capacity.
9.	MODS: MODS are defined for the purpose of this agreement as any add-on tools, maps, icons, waypoints, routes, waypoint or route management routines or software plug-ins. 
a.	You agree that we do not implicitly or explicitly guarantee, endorse, or approve of MODS, and that the existence of such MODS does not indicate any association between us and the developers or distributors of MODS. 
b.	You agree that such MODS may contain malicious or invasive code.
c.	You agree to indemnify and hold us harmless against any claims, actions or demands, including without limitation reasonable attorney and accounting fees, alleging or resulting from the development, distribution, or use of MODS.
d.	You agree that if you use third party MODS they will not be supported by us in any way, and may void the warranty.
e.	You agree not to develop, distribute, install or use MODS of any kind.
10. Multi-user use:  If this product is multi-user compatible:
a.	You agree not to use the full version of the Software in a multi-user environment if you are aware that any user does not have a separate license for the full (not demonstration) version of the Software.
      Exception: IF and ONLY IF you are a home user on a home LAN you may run unlimited multi-user spawn clients with a single license. 
b.	You agree that any multi-user chat between users is un-moderated and further agree to indemnify and hold us harmless against any claims, actions or demands, including without limitation reasonable attorney and accounting fees, alleging or resulting from the use of the chat capability.
c.	You agree not to include any illegal, obscene, lewd, lascivious, scandalous, adult content, or libelous, material, or infringe on any intellectual property rights by use of the chat capability.
d.	If this product is a software game, you agree not to cheat in any multi-user game.
11. Limited Functionality "Demonstration" version: If this product is a limited functionality demonstration version you further agree not to:
a.	Alter or modify the program in any manner except to install or remove it from your system, or
b.	 Use the Software with any MODS, or
c.	Install or run any additional features such as any add-on tools, maps, icons, waypoints, routes, waypoint or route management routines or software plug-ins.
d.	Use the Demonstration Software in any multi-user environment if you are aware that any user is using a non-Demonstration version, or 
e.	Attempt to "crack" or develop or distribute "cracks" for the software that change or enhance its functionality.
12. Severability: You agree that if any part of this Agreement is held unenforceable, the rest of the Agreement will continue in full force and effect. 
13. Installation and Maintenance: You agree that the software will only be installed by a qualified systems administrator. You further agree that a qualified systems administrator will find, obtain and apply any available patches for the software, the hardware, and the operating system at the time of installation, at reasonable intervals, and before any significant use. 
14. Health and safety: You further agree to abide by all of the following:

DANGER: THE GLOBAL POSITIONING INTERFACE INCLUDED WITH THE SOFTWARE IS NOT DESIGNED TO BE RELIABLE OR REDUNDANT, AND IS NOT IN ANY WAY, EXPLICITLY OR IMPLICITLY, INTENDED FOR NAVIGATION, OR FOR ANY DECISIONS INVOLVING LIFE OR PROPERTY, OR FOR CONTROL OF ANY VESSEL OR VEHICLE.   

You agree to use and control the use of  the software, which includes the data and the GPS interface, ONLY for the entertainment purposes and NO OTHER USE:
a. Looking at the displayed terrain for purposes of aesthetic enjoyment or personal education.
b. Finding APPROXIMATE, UNRELIABLE locations of wrecks, fish holding structure, or interesting topography.
c. Determining the APPROXIMATE, UNRELIABLE location of your GPS sensor in order to facilitate a. or b. above.

You agree NOT to use the software or allow the software to be used for any purposes not explicitly permitted above, including but not limited to:
a. Navigation.
b. Skin or scuba diving or dive planning or dive breifings.
c. Obtaining information for communication to any third party via VHF radio, the Internet, or any other means.
d. Controlling any vessel or vehicle
e. Any malicious use, including but not limited to causing harm or damage to persons or property, or relaying information to facilitate causing such harm or damage.
f. Planning or coordinating any group activity.
g. Display or output any information generated by the software or GPS interface to any system other than the computer system display on which it is installed. 
h. Save or transfer captured images of the display or displayed terrain.

WARNING:
USE OF COMPUTER HARDWARE AND SOFTWARE, CAN CAUSE SERIOUS AND SOMETIMES IRREVERSIBLE INJURIES AND DISORDERS. 

SEIZURES:
Some people may have seizures or blackouts triggered by light flashes or patterns while using computer software, even if they have never had a seizure before.
You agree that if you ever had a seizure, loss of awareness, or other symptom linked to an epileptic condition you will consult a qualified health professional before using the software.
You agree to stop using the software and consult a doctor if you have any of the following symptoms:
Convulsions
Eye or muscle twitching
Loss of awareness
Altered vision
Involuntary movements
Disorientation

You further agree to minimize the risk by:
Not using the computer if you experience fatigue, pain or soreness
Using the computer in a well-lighted room if possible, with lights positioned to minimize glare
Taking frequent breaks
Maintaining good posture
Practicing proper ergonomics
Exercising regularly.

WARNING:
CARPAL TUNNEL SYNDROME, TENDONITUS, EYESTRAIN, AND OTHER SERIOUS INJURIES CAN BE CAUSED BY MUSCLE TENSION, REPETITIVE MOTION, OVER-USE, INCORRECT OR STATIC POSTURE, USE OF A MONITOR, USING SOFTWARE, AND/OR POOR ERGONOMICS. THIS CAN AFFECT THE HANDS, WRISTS, ELBOWS, ARMS, SHOULDERS, BACK, NECK, EYES, NERVES AND/OR OTHER PARTS OF THE BODY.

You agree to follow these instructions to avoid problems such as tendonitus, carpal tunnel syndrome, skin irritation or eyestrain:
You agree to avoid excessive usage. 
You agree to stop using the software and rest your hands, wrists, arms or eyes for at least several hours if they become tired or sore during usage.
You agree to stop using the software and see a qualified health professional if you continue to have sore hands, wrists, arms or eyes during or after usage.

You further agree to stop using the software and see a qualified health professional if you develop any of these symptoms:
Presence of tingling, numbness or loss of sensation 
Inability to make a fist 
Weakness 
Cold hands 
Lack of control or coordination 
Having to self-massage frequently 
Pain or soreness
